Kenya Railways Director Philip Mainga Linked to another Ksh700 Billion Scandal

In a recent legal development, activists Francis Owino and Ezekiel Okoth have initiated legal proceedings aimed at the removal of Philip Mainga from his role as Director of the Kenya Railways Corporation (KRC).

The foundation of their case rests on allegations that Mainga was involved in the mismanagement of a staggering Sh700 billion in funds during the construction of the Standard Gauge Railway (SGR) project.

The activists, as detailed in their court documents, assert that various “illegal and irregular dealings” transpired, leading to the loss of this substantial amount, which ultimately burdened Kenyan taxpayers.

The SGR construction, primarily funded by the Chinese Government, has come under increased scrutiny. Owino and Okoth argue that the loan from a Chinese bank should not be classified as public debt.

Furthermore, the activists allege that both the Kenyan government and the Exim Bank of China purportedly disbursed a total of Sh1.8 trillion to the contractor and supplier of the SGR, even though the initial contract was valued at Sh407 billion. This raises concerns of a Sh777 billion overpayment with no clear accountability.

Court documents underscore that these questionable transactions occurred under the watch of Philip Mainga.

The activists go on to accuse Mainga of initiating a problematic agreement with Africa Star Railways (Afristar), a Chinese operator for the SGR Line. They contend that this arrangement resulted in unchecked daily losses of up to Sh1.4 million for Kenya Railways.

Justice Hedwig Ong’undi, presiding over the case, has ordered that the petition be formally served to Mainga and the East African Community (EAC), listed as an interested party, within a three-day timeframe.

All involved parties are expected to submit their responses within seven days, and a court hearing is scheduled for August 30 to determine further proceedings.

Adding complexity to the matter is Mainga’s recent term extension, which extends his tenure until 2026. The activists argue that Mainga’s continued occupancy of the position is illegal, given the alleged legal violations during his tenure.
